i think the penalty for texting while driving (TWI) should be like a DUI! I can drink and drive with ease, but I can't text and drive to save my life

We have the same law here in WA, and like NV hands-free devices are exempted. The problem is that all the studies show that hands-free does not make a difference, because the impairment factor lies in the brain, not the hands. Hence it is just a revenue ploy and any cop or politician who claims otherwise is either dishonest or an idiot.

The impairment factor also lies in the hands when it comes to things like texting, e-mailing, Facebooking, and surfing the web.

Why does it have to be all or nothing? Your argument sounds like you think we should either ban all distracting behavior no matter how distracting it actually is or we should ban no distracting behavior.
