You and I clearly don't agree often but I think we both agree that there are several people in this thread who'd better hope they never run into the same scenario as the OP because it likely won't end well for them.
Asked the local cops years ago about shooting into the ground to scare a thief or burglar and they said that would be assault on my part.
Need a firearm ID to purchase a BB gun 177/22 cal airgun. Assault weapons are legally defined and throw logic out the window as to what constitutes an 'assault' weapon. Of course the term 'assault' weapon is an effective anti-gun tool just like labeling the wall st pro criminals the 99%.

See how profusion of gun laws create more victims. If more criminals thought more people had guns there would be less crime. Target rich environment where feel good gun laws exist.

Having a shotgun in your home to protect yourself is one thing.
Roaming the streets looking for criminals and taking shots at suspects is completely different.

Don't shoot the ground, shoot the criminal, and be sure to kill him. When the police arrive you are to repeat "I was in fear for my life, I'd like to speak to my lawyer" like a mindless drone. Nothing else comes out of your mouth.
