I am going to fall into the position of this one as being way too little information to establish a conclusive opinion.
The use of force "appears" to be justified (she was drinking and driving, then resisted arrest), but the application of that force is in question (ie, was it a mistake on the officers use of the device, a malfunction, a accidental circumstance, maliciously intended, etc...).
This is why I think the baton is useful. It gets a bad rap, but it applies the necessary force to achieve compliance in many cases and doesn't have the risk of unintended escalation like some complex devices such as this one. You would have to go to town on someone with a baton to achieve that level of damage to someone.
It's a sad state of affairs when the people we pay to uphold the law have become armed swat teams.
What has led us to this?
People who continually resist arrest, assault police, try to take their weapons and kill them over something as trivial as a traffic stop, people who demonize law enforcement and create and "us vs them" environment has all led to this.
You know what happens if you have an encounter with law enforcement and you act like an adult and treat them with respect like you want to be treated? You don't get tazed, sprayed, beaten or shot. Over the decades I've had a couple dozen encounters with various law enforcement branches, many that also involved firearms and not once was anyone tazed, sprayed, beaten, shot or even arrested not even when I was young with long hair and a pony tail.
Now in this particular case clearly the officer was wrong. He used the wrong tool at the wrong time. He screwed up badly and should suffer the consequences.
Political shrills only pursue political means. Disregard them as they aren't relevant or meaningful in anything they provide. Just nod and wave, they don't deserve anything more.
It seems to me that the officer is poorly trained in the use of the spray... was he at fault? Yes... however I do find it funny... cops... can't use guns... can't use tasers... can't use pepper spray... can't use force... what exactly can they use?
its getting to the point where the cops have to politely ask the criminals, and those that refuse to obey orders, to comply or they will get cross and yell at the people.
A few months ago, a few bully cops decided to profile a black guy. The black guy was fed up with being harrassed and bullied by cops. He shot both of them. Unfortunately he died and they lived but it was still worth it. This guy was not a criminal and not wanted. He was just tired of being "pro actively" stopped and bullied by cops. Wasn't she driving while drunk? She could have killed someone.
Wasn't she combative while pulled over?
I'm not saying she got what she deserved, by any means, but she was driving while wasted...and a family could be mourning someone she killed due to her bad choices.
Now all the sympathy is for her, because she was pulled over BEFORE she did.
Bullied? Or, do you mean repeat offending felons who the police serve with warrants who would rather kill a cop than return to prison. Certainly you are not defending murderers are you?
At least a grand jury indicted him. Hope this guy spends some hard time locked away for what he did. Yet he claims he' innocent? Just another power-trippin', trigger-happy lughead with a badge.
