I am wondering how one can force someone to buy/pay health insurance when they can't afford it especially the long term unemployed?

It makes sense, if the Supreme Court held that it was a penalty and not a tax, then it would have violated Article I, Section 9, Clause 3 of the US Constitution, which prohibits Bills of Attainder. Meaning, penalties cannot be legislated, without the courts being involved. So they had to consider it a tax, which is a power Congress has under Article I, Section 8, Clause 1 of the US Constitution.

Not for me or for most Americans. We are already buying insurance.

The main problem is the increasing cost of health care. But that has been happening for the last 20 years.

I sure am.

Bet they'll get lots of play from Mr. Romney's Op-Ed from 2009, cited upthread, too.

If I were on the left, I would be VERY worried. 25 states have opted out and can continue to do because the SC ruled that the Fed cannot force them to comply with Medicare expansion. Without this, this means nothing changes in those 25 states except a new tax. Look, if you're a person that cannot get insurance and needed the state's expanded Medicare to get health insurance, then you are in the exact same situation and will NOT get insurance. You WILL pay a new tax though in the form of the Obamacare penalty.

The Court said that congress can't control the states and people under the commerce clause. I agree with this. They also said that congress has power to tax, which I also agree with. Where it gets fuzzy is when you tax someone based on their choices (and not income). Kind of uncharted territory. Note that the court never said any of this was a good idea - they just clarified what is Constitutional. The polls still indicate that it's an unpopular bill overall, so we will see how it plays out in November.

Wrong. My insurance is officially done away with by Obamacare in 2014. I do not get to keep it. Now the IRS can seize my home and property if I do not buy an totalitarian statist approved plan.

I call bs

Insurance has NEVER been CARE

I can open up the yellow pages and look up any doctor and make an appointment to be seen, as long as I PAY..not insurnace needed

the one thing you do fail to address is that many doctors are not taking new patients...why,,,because there is a severe doctor and nurse shortage
