When I lived in Texas I had a cop tell me that if you accidently shoot someone, go in the house and get your DVD player and put it in his cold hands and its ALL GOOD according to the law.
Florida is getting more and more like that but they have yet to extend your right to use lethal force to protecting your property to my knowledge. If I feel threatened then I can use lethal force even if I am not at home at the time. So we're getting there.
Why did he shoot to kill? Is killing the correct response to theft?
I would say its not a bad response. He used a shotgun. Chiel a shot gun by nature inflicts devestation on its target.
Bottom line is had they not been caught in the act of committing a crime, ie obeyed the law and not resorted to crime they would be alive.
Criminals are what they are, not much better than rabid dogs.
The man asked them to stop, they continued towards him. What could have been on their minds? Murder? Mayhem? or a good ole fashion beating of the eyewitness? They got the exact reward they earned.
If you are trying to stop 2 thieves and hold them by gunpoint so they don't go running into the night just to do the same BS to someone else, then yes, its okay to shoot them if you inform them you will shoot if they move, and you are calling the police to have them come pick up the burglars. For all the guy knew, they were going to jump him, take his gun, then kill him. Thats why I have no problem with this situation, especially with the evidence that he was trying to get the cops to get to the scene before it went bad.
