Under Minnesota law, a person may use deadly force to prevent a felony from taking place in one's home or dwelling, but authorities have said Smith crossed a line when he continued to shoot the teens after they were no longer a threat.

Thats the beauty of being a criminal , when you are breaking and entering someones house , well then you are gambling the consequences. Want to stay alive? Then dont commit crimes

The idea that every crime deserves death, is a interesting one.
Smith, armed with a Ruger Mini-14,[1] shot the teens separately and minutes apart as they entered the basement where he was, later claiming to police he was worried about them being armed. By his account to police, he shot Brady twice at the top of the basement stairs, and once in the face fatally after he fell to the bottom of the stairs. Minutes later when Kifer entered the basement, he shot her at the top of the stairs. Wounded, she fell down the stairs, and after Smith's rifle jammed, he shot her multiple times in the chest with a .22-caliber revolver, dragged her across the floor to set her beside the body of her cousin, and then shot her fatally under the chin
The best part is the girl. . having a weapon jammed (and girl no longer a threat) . . .and continuing to shoot several times, and then put one under her chin.
I would have very large concerns with any judicial system that allows this man to ever exit a prison.
This man stopped the people
and this man then SHOT helpless people on the floor. . .
The crimes of this man. . .so much more egregious than the ones of the two young teens.

Wrong place , wrong time ... Looks like they took on a crime far greater then they expected.
they were not children trying to get a glass of milk, they were criminals under 20 committing a home invasion.
he was not a trained police officer he was a home owner trying to protect his kids. so proper use of force should not measured the same as for a police officer. why is it everytime a crime is committed we put the victim on trial????
pineapple upside down cake.
Don't forget what he admitted to saying to them while he shot them. He could have easily avoided being charged by stating he thought they were still a threat even though they were on the ground and also not deciding to get up so close and personal with the .22. People on the ground can reach for a weapon even though they have been shot. But you better damn explain that fact if you did shoot someone while they were on the ground after you had shot them in self defense.
Despite what you may feel setting a criminal on fire after you have shot them or tied them up after they had tried to rob your house or attack is not allowed by the law.
You cannot defile the bodies of dead criminals either which is a damn shame.
BTW, people in Minnesota (and hopefuly in more and more states) need to know that if they commit a crime that can be regarded by the victims as a threat, the perps are risking their lives and may lose them.
That's the way it ought to be. A lot fewer crimes will get committed as a result... and many more lives preserved, as they should be.
And it will be up to the criminal to decide whether the crime is worth his life.

I agree with this. Once you're faced with a situation like this, you don't have time to think about all the laws that favor criminals who break and enter into your home. Your one goal is to protect yourself and your family.

You may want to read what he said he had done. That is why he is getting charged.
