Does anyone familiar with Minnesota law know what the probable sentence for the two teenage intruders would have been had they survived? Just curious.

Since there is no death penalty in MN we know it wouldn't have been as harsh as they received.

Do you agree with the Murder 1 convictions though?

That one is tough for me. Seems the prosecution has left the door open to having these convictions thrown out. The Perp has the money to hire Mechbescher (one of the top attorneys in Minnesota) so I expect a vigorous appeal.

In an earlier post I said I was a little surprised by that verdict, yet I have respect for the juror's decision. I have been on two juries myself (one criminal-homicide; one civil suit).

I think an attorney of that caliber might be successful in getting a reduced charge and sentence. I doubt he will get a full acquittal. Is that how you view it, too? Mine is just a guess. Don't know exactly what Mechbescher's recent track record is, but I imagine it is very impressive if he is one of Minnesota's top attorneys.

As to the teenagers, they had a history of doing these things. Whatever the maximum sentence allowed by law would have been my preference had they survived.

I misspelled his name-it's actually Meshbesher.

But yes, he is probably the most famous attorney in MN. I expect him to bury the State Prosecution in paperwork and pummel them until they either drop the sentence or the charges and Smith walks.

huh. I didn't expect that, I figured the first count might get a not guilty, and the second count with the execution of the female would be the one that would get him.

I checked the attorney's website. Mr. Meshbesher has personally retired, but his firm still practices and has several attorneys that represent clients. He had been practicing for well over 50 years! There could be a whole new thread about what happens in Little Falls, MN between the people that knew the teenagers and the people that know Smith if he gets the charges dropped for a full acquittal.

Thats highly unlikely. But if it did happen.....yeah there would be drama like you would not believe.
