The Hillary Tapes | Washington Free Beacon

Her job as a lawyer or not, she had a choice to take this case or not it seems. She took it, knew he was guilty, yet worked to get him off with a slap on the wrist. I dont care if it was her job, you cant have morals or good character to knowingly free a child rapist.

Good read on this at the link above.

You dont change DC for the better by electing people like this. You Hillary supporters must be so proud. Along with her not having accomplishments worthy of being President, why on earth would you want someone like this in DC, let alone as our, as your President?

I see that this story was reported back in 2008, when she was running for the Democratic nomination:

Carlson asserted Clinton's court-appointed representation of rape suspect was "immoral" -- but legal experts say she was doing her job | Research | Media Matters for America

I guess the question is: should this man have had the right to representation in court? He was charged with a heinous crime by the State, but does that mean he did not have the right to representation?

I also, early in my legal career, was court-appointed to several criminal cases. In at least one case I also knew the person was guilty. Nevertheless, I made the State prove guilt beyond a reasonable doubt.

But, then again, I believe in the Constitution.

I'm not a Hillary supporter in the slightest, but this is not a good argument against her. It appears that it is our legal system itself, if anything, that is really provoking your ire.

Should she have told him 'find another lawyer; I might run for president some day'?

Everyone has the right to representation in court...we run into real problems when someone doesn't have that. Ask some of the guys who have been shown not to be guilty after years on Death Row.

Court appointed lawyer that actually did their job?
Was the perp connected to the elite in some way?

That, of course, is why our "legal system" is not a "justice system". Justice is not served when known criminals are released on the streets due to flaws in the legal system. In such a process, we turn morality and knowledge of what is right and wrong into a cynical farce.

On the other hand, in medicine, we can be more "just". If I have a work comp patient who is faking thier injuries and shows positive Wadell's signs, I tell the attorneys on both sides the truth. My job, unlike a lawyer, is not to protect criminal activity due to technicalities.

I can sleep at night- I wonder if attorneys can?

I imagine most can sleep well at night.

I do disagree that making the State prove its case is a 'technicality'.

I do realize that, to many, an indictment should be equivalent to a conviction.

I also agree that a Medical Doctor is not suppose to 'protect criminal activity due to technicalities'. Well said.

A lawyer has a duty to zealously represent his client. Lawyers are not mind readers or can look into people's souls. If someone says he is innocent, who is the lawyer to question him. His duty is to advocate for his client and win the case.

The fault therefore lies in the legal system. Though our legal system is among the best in the world, it's greatest flaw may lie in its adversarial process. The adversarial process may be the best way to get to the truth, but it also puts an emphasis on winning. Though justice is what the legal system was created to serve, it has in many instances become a contest between lawyers to win the case and not justice. To quote Vince Lombari, in today's legal system, winning isn't everything, it's is the only thing.

IMHO, there is a big difference between representing a defense client, and pulling out all the stops to get them off with the least possible punishment. Doing the later is really in the lawyers interest, to up their reputation, than it is for the good of society. Hillary is really all about Hillary. She's a classic sociopath, I think. Everything in her life is about getting to the top. I'm sure she stayed married to Bill, only because she thought it would be better for her career.
