She is challenging it on legal grounds. All public health issues SARS HIV TB have legal precedents. This is the way it rolls out over decades. She challenges court rules and laws are enacted. While I may think her position is somewhat concerning she is well within her rights. Typically "an infected person" is the cause for quarantine. There is no one infected here in this case.
There is a long discussion on the Ebola in our Midsts thread as well.
Could you imagine the outrage from ACLU if there was an island set up like Gitmo for Ebola exposed people.
At one time leprosy ran rampant, we have come along way from putting the people on an island and leaving them. Why can't they be quarantined in Africa for 21 days before coming back. Or at least an in between spot. Notice even the President doesn't agree with quarantine.
The ACLU would represent the remaining terrorists housed at gitmo and charge the US with endangering their clients
The state can prove a public health interest by the oft cited 21 day incubation period. The state has the right, held up in court many, many times, to enforce a quarantine.
The state has rights. And the individual has rights. And since the self-monitoring protocol has been effective, even in the case of the NY doctor who came down with Ebola, but also in the case of the hundreds of health care workers around the world who've volunteered in the stricken countries and returned home, the state has to prove that the quarantine is warranted. And the science and the history don't bear that out.

Exactly, this is the way the legal system is supposed to work. Arm chair quarter backing about "what I would do" is not helping the situation. No one knows what they'd do be locked in a cage for 3 weeks without their consent, and without due process.
Ellis Island weren't citizens, they were foreign nationals seeking entry into our country. We could do whatever the hell we wanted with them. She is a natural US citizen, as such, she has rights to due process.
A dyed in the wool liberal. She bleeds for the disadvantaged people who live on the other side of the ocean and believes America's deserves all the misfortune that comes her way.
Hadn't thought of it this way, you make a good point!
Notice how Ebola is getting all the attention and Enterovirus 68 is not!
She is being detained, against her will, without due process of law. The Governor of a state just can't make you stay in a bubble for however long unless there is a law, or a jury that says its ok. She is well within her legal rights to challenge this.

Wonder if she has an absentee ballot? The election for gov is next week and she would be not allowed out of her house.... add 'right to vote' violated to her lawsuit
