The only problem with this is that there has been no federal law passed. The 14th amendment says equal protection under the law. It doesn't need to specify which laws. If it did, the amendment would be longer than the entire constitution.

Well in order to have equal protection under the law, one has to be recognised as a protected class. For example, woman and married couples are a protected class. Uncustodial fathers, dog lovers are not.
