If you're armed and protecting yourself from another armed civilian, but you have just committed a violent crime, are you no longer able to claim self-defense? I feel like this is a dumb question but I genuinely do not know the answer.

In the case of the OP's original news link. The shooter in this case shot at his wife twice, striking her once in the lower extremity. The deceased took action to stop the man (presumably to hold until LEOs showed up). I think any credible attorney would win this case, in which the shooter is the aggressor, who committed a crime (he shot at another human before killing the deceased).

That's my take on it anyways, with the few details in the article.

He escalated the situation, and it cost him his life. Very sad, but hopefully it will serve as a cautionary tale to others.

The shooter will likely try to claim self defense. It probably won't fly since he'd just shot his wife and was trying to escape.

The shooting occurred "during the commission of a crime" (that includes the getaway from the crime), so self-defense probably won't be an effective court defense. At least not in most states.

The gun-owning community does need to put some pants on the meme "The only thing that stops a bad guy with a gun is a good guy with a gun."


The purpose of a civilian carrying a gun is to survive the moment. The armed citizen is not a cop. As far as I know, every gun license certification course teaches that point.

This is a tough one. Witnessing someone innocent getting shot and you are the only one keeping the perp from escaping. IMO the only thing he did wrong was not pulling the trigger first. Once you commit, you need to fully commit.

Nothing tough about it. At that point, rendering aid to the wounded and calling the gendarmes was clearly more important.
