Not arguing but pointing out 'negligent' laws and their silliness:
In Florida, and many other states, if someone illegally enters my pool, and drowns, while trespassing, I am held liable. Even if I have a fence/lanai and it is properly secured.
You did hit the nail on the head: it is a tragic accident and the family will suffer indefinitely. Yet people will use this (evidenced by this forum) for their pet cause du jour.
Here in Missouri, my agent said that the pool could have a locked cover, and if they broke into it and drowned, I would be liable.
When I go to the range, I follow the rules. This idiot did not follow safety rules and his daughter is dead. I trust my grandkids to not touch my gun, but I don't leave it laying out in the open when I leave the room.
From what I could see in the article, in all the transitive sentences in which "shot" was the verb, the subject referred to a human being. I didn't see any indication that the gun raised itself up from the table, aimed, and fired at anyone.
I'm not beyond consideration that some kind of reckless endangerment and manslaughter charges should apply in such cases. At least whatever charges would apply if a child had drowned in an unsecured pool.
From what I gathered the gun was legally owned by a guy who will possibly be facing criminal charges for allowing it to happen, but this country has such a hodgepodged patch work of gun laws from state to state, county to county and municipality to municipality that it's hard to say. In areas with stricter gun laws it is a crime to keep loaded weapons unlocked if there are minor children in the household.
Gun didn't kill the girl, she was only being a curious kid, but here we have a negligent, sad father..
Well they DO go off by themselves sometimes I have read.... We cant forget those cases
