Just a reminder.

In one of the few disability-bias cases successfully prosecuted, in 1999, Eric Krochmaluk, a man with cognitive disabilities from Middletown, N.J., was kidnapped, choked, beaten, burned with cigarettes, taped to a chair, his eyebrows shaved, and ultimately abandoned in a forest. Eight people were subsequently indicted for this hate crime — making this one of the first prosecutions of a disability-based hate crime in America.

There is a reason why that people with disabilities are covered in the federal hate crimes statute in order to bring the full protection of the law to those targeted for violent, bias-motivated crimes simply because they have a disability.

Again, not sure why some here say this is not a hate crime.

agreed.

Also, people need to understand the definition of hate crime.

According to FBI

For the purposes of collecting statistics, the FBI has defined a hate crime as a “criminal offense against a person or property motivated in whole or in part by an offender’s bias against a race, religion, disability, sexual orientation, ethnicity, gender, or gender identity.” Hate itself is not a crime—and the FBI is mindful of protecting freedom of speech and other civil liberties.

CNN did cover it and its panel discussed whether it was a hate crime with some disagreement:

While the definition of hate crime laws varies from state to state, in general, it is a crime committed against an individual because of the victim’s:

race
color
religion
ancestry or national origin
gender
disability, or
sexual orientation.

Some hate crime legislation also protects people based on homelessness, gender identity or expression, and political affiliation.

So if this poor man was kidnapped or tortured simply because he was a man, disabled, or white, the crime fits the definition of a hate crime.

Not sure why some here say this is not a hate crime. It doesn't have to be "race" related.

Anybody can be victims of a hate crime.

I agree with this, which is why I stated, I felt the victim was targeted not based on race but disability. Unfortunately, disabled people are routinely targeted for abuse.

But it seems many of the posters on here want this to be a "white on black" hate crime. Honestly, I wouldn't care if it was and don't understand why it is so important to them, but IMO he was targeted because he was disabled and easier to victimized due to his disability.

Also, not all states have hate crime laws and like what was mentioned above, all of them are not the same or cover the same types of biases.

This seems like a biased interpretation that lacks foundation to me.

So you think that the victim could not and would not be targeted based on disability?

The profanity was involved because they are enjoying humiliating their victim like the sick individuals that they are. Also, that was not the majority of the video. Your "interpretation" rejects all other things spoken and involved in the torture of this individual except his race.

And again, a previous case was mentioned whereas a white teen (over 18 years old) anally raped a black, mentally disabled teen in high school with a freaking hanger and IMO he was targeted because he was disabled, not because he was black. He called the black kids various racial slurs multiple times. Even so, it was not tried as a hate crime based on either rape or disability and the perp got a slap on the wrist and no prison time at all.

Because they couldn't care less about the victim(s) in these types of stories, just only care about peddling their agendas (liberal media, blacks, etc.) at the expense of the actual victim(s).

I agree. Would these degenerates attack this man if he were not disabled?

Probably not.
