This seems very shady, police will release more details today, but his actions are hardly acceptable under any castle doctrine guidelines.

I think there's a lot more going on...

Homeowner arrested after fatally shooting intruder he found in his shower: Police - ABC News

Quote:
The homeowner said he arrived at the home, one of at least two that he owns in the Belfair, Washington area, at around 8 a.m. and noticed that a door had been kicked in, according to police.

The homeowner went inside and exchanged words with Rosa, who was in the shower, at the time, police said. The homeowner left the premises, without calling the police, and returned with a firearm, police said.

"He returned home, retrieved a firearm, came back over to the residence and fired multiple rounds into the shower ... killing the intruder," Mason County Sheriff's Lt. Travis Adams told ABC affiliate KOMO.

The fact that he left and then returned with a gun, without calling the police, and then shot the guy is why he was arrested. But you already alluded to that. I just threw in to try to help tamp down the stupid that will soon appear.

That's the way I see it. I support your right to protect yourself. This guy wasn't protecting himself.

I haven't read the article but if indeed the owner left and went back with a gun to shoot the guy without calling the cops, that is no self defense!

I rather wait to hear the entire story but based on what the OP wrote, my answer would be in the first sentence.

It sure does sound shady.
It does sound like the Police got it right by arresting the shooter and the details will come out in court.

What is the defense? Was the homeowner threatened with a loofah or maybe he feared the intruder would get soap in his eyes?

It sounds more like the shooter had a bit of regret after having a gay roll in the hay with his victim.

That guy remained in the shower while the owner had time to go to another building and retrieve a firearm?

Shades of Oscar Pistorius ?

Wow. Almost 15 minutes since the thread started and only smart people have responded. I'm somewhat disappointed.

It doesn't even sound like he lives in that home because the article said the home was "one of two that he owned in the area". This could be a situation of a squatter that moved into the home or maybe someone that had lived with a person on the lease at that propery. In these cases there are legal remedies to remove the person from the home and you cannot even go in there and remove their belongings or physically force them out and certainly no right to shoot them.

For example, if the landlord was leasing to John Smith but John Smith brought in a roommate but didn't tell the landlord. Then John Smith moves out but the roommate stays behind. In this case the landlord has to legally get rid of the former roommate and cannot kick them out immediately. Same with a squatter.

I guess the land lord was defending his need to minimize his water bill. Hell, the physical cleanup will cost him more then just telling the guy to leave. The legal cleanup will cost a whole hell of a lot more.
