Lots of countries do merit based visas. Personally, I think it is a good idea but I would feel nervous having a Trump official determine that "Merit" given his previous statements about who makes "good" Americans.

The criteria should be for Congress to determine.

Also using the murder of innocent bystanders to further your political agenda is just one more negative for Trump.

Actually, there were Republican judges who opposed Trump's ban too.
I know you don't realize this, but Trump isn't an Emperor. He doesn't get to do anything he wants.
