Too bad Trump already started undercutting any claim of privilege by claiming that Cohen only handled a “tiny fraction” of his legal work. Also, illegally funneling undeclared campaign contributions to be used as hush money is not protected by A/C privilege anyway. Inconceivable!
If it can be proven that Trump (or his team at his direction) released the tapes then its a clear waiver of his privilege and the material would then be admissible.
Latest reports are that the prosecutors had not reviewed the tape because it was still being reviewed by the Special Master and as such was still considered privileged. Trump's legal team went to the judge in the case and requested that privilege be waived. For whatever reason, Giuliani seems to believe the tape does Trump no harm.

he seems to be relying on the fact that in the end it was the national enquirer that bought mcdougal's "story" ( and promptly buried it ). i doubt that separation will help trump if cohen has more tapes discussing the specifics with trump or the enquirer.
