Several days ago I opined in this thread that Stormy's first lawyer Keith Davidson had several problems. One is the fact that Cohen doubtless recorded their conversations without his knowledge in violation of CA state law. I am confident that SDNY has heard those conversations in the evidence they gathered. To use those recordings as evidence against Cohen Davidson would need to waive his right to privacy under CA law with respect to those recordings. That is, I think, how Davidson is cooperating with SDNY.
For those who criticize MSNBC and the Washington Post, I watch and read broadly. I also look for supporting and bebutting information. Any reporter can make a mistake. I clearly state when what I write is conjecture.
For many years I prepared cases for litigation, all but one were settled out of court in the favor of my employer and the one that went to court was a win. To have such a record an investigator must be through, thoughtful, strategic and know the laws enforced. It also helps to have smart lawyers at your side of the table. Back in the 60s my agency was the only law enforcement agency to send a member of the mafia to jail.
