This to me is a deal breaker... it's like having a gun and pledging you will never shoot unless you get shot first. Why do we need to see NYC blown up before we can protect ourselves?

The real answer is it doesn't matter since it is non-binding and first use poses high risk of uncontrolled escalation.
If the US were to ever be involved in a nuclear war with one of Russia or China, indications are that the US will strike against both based on past close call incidents where orders were to launch against both. They may go farther and attack in addition whomever they fear will become a regional superpower.

If NYC gets blown up it’ll be by individuals, not a state therefore won’t be anyone to nuke in retaliation.
