There has to be some reasonable fear of being harmed or being victim of a crime. Simple trespassing isn't enough in TX to shoot (now if they were breaking into a house, that's another story entirely).
Whether they were on the property or not is unclear. Even if they weren't, they were close enough so that the shooters reasonably believed they were about to trespass, thereby making the shooting justified. Ever heard of a preemptive strike? I believe that's a concept that also came from Texas.
If it was justified they wouldn't be charged. This is not a Joe Horn case. These folks should get the chair themselves for killing that kid. Some fools will blame the guns & the law in Texas, but neither one was responsible.

Those kids and their father are responsible. If you're somewhere where you shouldn't be you deserve to get shot.
The reason all these things go on? We have 25 million people. California is the only state with more people and when you compare, they probably have more bad things happening.
And when you say "there are millions of fine people in Texas," replace millions with 24 million.
This wasn't meant to be rude BTW. I just had to stick up for the Lone Star State!
You're right, I'm guilty as charged.

They were not on private property, even the shooters knew that!
DeFoor said Sheila Muhs then called 911 and told the dispatcher: "They're out here tearing up the levee, so I shot them."
DeFoor said the levee belonged to the subdivision and was not private property.
Like I said. They shouldn't be where they shouldn't be. They don't live on that levee. They shouldn't have been tearing it up.
