And it won't. If (and that's a huge 'if') a challenge gets to SCOTUS, they will likely exercise the doctrine of non judiciability. In a nutshell, they will refuse to hear it on the grounds that it's not for the judiciary to decide such matters.

The Constitution says bills. Amendments to existing bills are a separate matter. The whole thing is DOA at the USSC for a number of reasons. Even if by some tremendous miscarriage of justice it survives, a bill to repeal it will be on Odumbo's desk next year.
