Yes it's happened before but Fitzpatrick wasn't active duty.

The court addressing Orly's case specifically evaluated the proposition that a member of the armed forces is entitled to refuse to obey an order until they get proof, satisfactory to them, that Obama was born in the United States. The argument was rejected.

Just about every possible criticism of Orly Taitz is justified.
Nevertheless, just as we object to the wingers when they use corruptions of Obama's name for whatever juvenile thrill it gives them, it doesn't elevate the debate to do it to hers.

Uh, no. She was asked, through an interpreter, if Obama was born in Kenya. The interpreter misunderstood her response. You can google the transcript. It wasn't his grandmother, it was his grandfather's wife, too.
