Yes, on one hand, we absolutely need to do something to stop illegal immigration. I don't think it's fair for illegals to come and get all the benefits without paying their share of taxes. We need a comprehensive solution that starts with real border control (hasn't happened under Democrats or Republicans, by the way).
But as conservatives who supposedly care about Constitutional rights and subduing an intrusive government, you should realize that they just gave the government in Arizona a LOT of power: the power to basically stop and interrogate a segment of people for pretty much any reason they come up with.
Practically speaking, what is "probably cause" in this case? Looking like a hispanic? This may be the first law that effectively legalizes racial profiling.
Today it's the hispanics. But once that precedent is set for allowing cops to detain people at a whim, then how long do you think it will be until you're the ones who are being stopped and detained for not having your "documentation" with you?
It's tough to keep the Constitutional principles intact when you start to apply it differently based on race. If you want to live in a fascist state, then this is a real step in that direction.
You act as if the cops are going to start interrogating everyone. Unfortunately you're trying to blow this thing out of proportion for your own political reasons. Arizona is in dire need of immigration reform. The state spends an egregious amount of money in some way shape or form managing the damage caused by illegal immigrants.
Illegal immigrants in Arizona are for the vast majority, hispanic. This bill provides a crucial first step in combating the problem. It attacks the source. It is a bold measure and I think going to be highly effective, this is why most of the hispanic population doesn't want it. They would love to have immigration reform proposals that pretend to take care of the problem but really do nothing. Then, when something actually useful comes around, they cry about it being unfair.
This measure taken by AZ is cheap and effective for the time being. They can utilize existing resources (the police department) to take the issue into their own hands. How frustrating do you think it must have been for the cops to see someone suspicious looking and not be able to do anything about it for fear of "intruding on their civil rights". This is why problems keep getting worse. Nobody wanted to actually do anything about it... they just wanted to play political games and make it "appear" the government was doing something about illegal immigration. Finally, we get something substantial that will cut the nonsense and get to the heart of the matter.

So riddle me this:
On what basis will the cop identify someone as "looking suspicious" of being an illegal immigrant? What will be the probable cause?
I can tell you the answer, but I'm curious to see what you'll say.

I posted this link in another thread about Brewer/AZ immigration law. Obama is already pushing Congress to close the loopholes so other states can't follow AZ's lead.
Great. So rather than seeing it as a wake up call that the fed need to get their arse to work on this issue, he instead tries to block other states from doing what needs to be done. Frickin' traitor.

Jan Brewer signed a law that is in direct opposition to the Fourth Amendment of the Constitution of the United States. It will make it to the Supreme Court for review, and they will strike it down. The law should be thoroughly excoriated at the next round of Tea Parties, whose attendants say they are in favor of the Constitution.

But, I have to agree with other posters here, that such a law could either be construed as legal profiling, or certainly, it could be abused. Constitutionality of it will likely be challenged in court, for sure.
It is still a step in the right direction with the message it sends.......
people ARE fed up with illegals and such a bill, becoming a law........clearly indicates this.
Now.....watch the approval ratings of AZ's Governor and let it all play out.

But......it has also upset the current administration, which......just like the previous one's.......can't stand it when any state goes against the grain with the Fed. Govts. wishes of conformity....through uniformity....and especially on THIS issue.
