NJ laws are different from NC. I moved from Jersey a few years ago. I would contact her broker in charge - and vent with him. Also, have a lawyer review your contract - lawyer will let you know if you can back out and what she may hold u liable for. And I agree with other responses, don't go by how many listings someone has. You want a hands on person. Someone that has none or a few could work well or just as bad as your current agent. I would try to find out who is selling the homes in your area, not who is listing them. Example: there may be alot of listings by Century 21 but they are being sold by Fonville. That means fonville has the buyers that's who u go to. Curious where in Jersey u are from?
We are in upper Passaic County, right above Oakland.

I don't her side. Obviously she's successful even if the communication isn't great. Is she by herself, does she have a small team, large team, marketing specialist...I am not taking sides but I don't know enough to judge your situation.

I don't think I'm asking for judgement Brandon, what I am saying is that she is not following through with what we hired her to do. Maybe some don't mind the lack of communication, maybe some don't need to hear from their realtor more the every few weeks, but we do, and we made this very clear to her when we signed the second contract in January. She brought in buyers that were no money down and led us to believe that we sold our home with a congratulatory letter and phonecall, only to call us 2 weeks before the closing and tell us the deal was off. We now know that you need a good working realationship with your realtor and we just don't have that with her. We have a very large, older home that needs a realtor to be attentive and involved, not just sit on the market. We have young children and they have been on a roller coaster ride since the listing of our home last August.

No money down? What does that mean? No escrow or 100% financing?

I know where that is. We were in jersey 2 weeks ago for my sister in laws retirement party they live in Parsippany. And of course where else would the party be held but
"THE Brownstone". God that place is so good. The food we had there u cannot get here! I'm serious. There is only one restaurant that comes close to it and that's Cassalinga in Raleigh. We actually drove back with our car loaded with Italian groceries from Corrado's. But seriously, let your lawyer read thru contract for u. Make sure u are able to break it. Here in NC you can fire your agent at anytime, whether agent is listing agent or buying agent. But again client has to make sure of their liability if any. lol

I work at a local hospital in that area and all our company parties are there. Fabulous! Corrados too. Thank you. We will speak to our attorney first.

I would look at the Sellers Agent contract and see if you can get out of the contract. Just telling her that you are unhappy with the deal is prob enough to make it voidable. Then see a lawyer if you need. Most people think just what you did, but the most pics in the yards dont always mean the best solution for you. In her defense, she may be too busy to handle all the contracts. The agent who said he d never sell any of her houses is in violation of anti- trust laws and shoudnt be a very good choice either. Most agents try as hard as the can to do a good job for all involved, but if it isnt working for you then its not a good deal for either of you. Id let you out of the contract if you were unhappy with me. But ther is prob a 30-45 day caluse in there for you not being ablr to sell to anyone that she has presented for that time frame after contracrt is voided. Hope this helps. It can be frustrating for the seller. agent anfd buyer too. Good luck

Thank you. What my husband plans on telling her is anyone that has seen the house at the time she represented us will of course, be credit for her, and any new realtor will also have to be in agreement with that. Some feel that it is just the right thing for her to do to save her reputation, allow us to cut the ties and go our own ways...

I didn't need to read any farther than this
If this is true, it's pretty clear where this horrible woman's interests lie - with herself, and nobody else. You never want to choose a person like this to work for you. If they are shamelessly unethical with others, they'll be shamelessly unethical with you too.

(Frankly, if any salesperson had the unmitigated gall to pitch their services to me or a member of my family at a funeral, I'd immediately throw them off the premises and file a formal complaint with the necessary person/organization overseeing them)

But back to your topic, there are many threads in this forum related to ridding oneself of an unprofessional agent. You'll find the answers you need among these

P.S. I also had one seller's agent who failed to give regular updates. I don't think a weekly update is too much to ask. It's so important to stay on top of things nowadays if you want to sell. So I sympathize with you, also regarding your agent perhaps not paying enough attention to showing to qualified buyers. Fingers crossed for your next step.
