Our county regs specify aerobic septic. The island is big enough to where it shouldn't be a problem.
I'm not sure about the Corps of Engineers-- the larger island just 50 years north seems to be going into development. It might be a good question.
There are no cool places in Texas during the summer. Ft Davis in the mountains is not too bad. The ocean breezes do moderate somewhat and sometimes I notice Rockport may be 7 degrees cooler than Austin and the waterfront a bit cooler than that, but its still hot to me.
Not knowing how Texas works I will say your questions are good ones.. allow me to ask too? Wont adding septic be a killer and especially in the middle of public waters, just because you own it may not mean you can build anything anyway you want on it . Septic ? I doubt it.. but maybe Texas and Texans are more concerned with "do as you want" than they are with e.coli in public waters. well until some kid or kids die from it anyway.. Fresh water just add a pipe under a public water way .. adding a navigational hazard into a public water-way ( potable water pipe) for personal use ..why would anyone think that would fly? So you have a Holding tank for waste ( which will have to be pumped out regularly) and a cistern ( catch basin ) for potable which is either trucked and barged in , or its captured rain water.. You will have to pay cash to build the house because Hurricane Flood and Storm damage Insurance is going to be huge.. Solar cost could easily run $25,000 for a modest system.. BUT if your a MULTI-Millionaire who really wants to own a home in Texas, maybe its all doable? So having only a little knowledge of the general area. Isnt your island in a mud flats area?
You could avoid high insurance rates by just building above maximum storm surge height, which is about 40 feet in the gulf. There would be substantial stairs to climb, but a house supported by heavily reinforced concrete pilings should be able to ride out a hurricane. Of course there might not be an island there after the storm passed, but if the pilings went to bedrock the house should be OK.
Part of the problem may be that I was in a lawsuit over this land for 9 years while the person I sued went to prison twice. It was all settled a month ago -free and clear, however the local paper does not report suits and I have moved away. Many may think this is still tied up in nasty litigation, but its not.
If I was in the market I wouldn't touch this. You can say it's all settled but lawyers have a way of finding grounds for appeals. In any event, it means your land is contested and/or there is bad blood involved. You may be in the right but who needs these kinds of problems?
Seriously . Market it internationally. Find a real estate co that does international marketing. There is a guy building a 100 MILLION dollar house in Dana Point CA. Those are the people you need to market too.

Umm I was the lawyer representing myself. Both sides signed and filed a Settlement Agreement and they deeded over land to me. In Texas there is at most 30 days to file a Motion for a New Trial. That period has passed. Its a long and interesting story - I put the person on the other side in prison twice during the 9 year period. He may be an honest guy now. There was a 3rd person in part of the case. At the last settlement conference their attorney said "We have spent $360,000 on this so far" I said "Yes I hear you, I've spent over $900 myself" I think they got the point.
As for that broker -- I told him to bring offers -he is not my broker but I think he's pretty retired.
