Does anyone know the laws regarding dog poop ? If someone lets their dog poop on my lawn and leaves then I find out who did it....what can I legally do ? If I have a physical altercation with them can I claim self defense ?

What I do now is flick it into the middle of the street with a magazine for everyone else to enjoy. Luckily I only rent this property . If I was the owner and saw someone do that I would go ape **** on them.

What if I actually see this happening at that very moment....can I defend myself legally ? What if I threw a piece at the dog owner. Would I be liable for assault ?

Thanks

There are no laws regarding dog poop. Some people even have videos from their doorbell cameras showing people letting their dogs poop on the lawn. If you know who did it, you can pick it up and put it on their doorstep.

This is an ongoing subject on NextDoor, and it's never ending.

Thanks for responding. I am dead serious about this topic. I find it really offensive. Also Covid has shown up in dogs and I don't want steaming dog crap anywhere near me.

I never get to see the person doing it. Only once I noticed a guy's dog peeing right in my walkway before I enter my house....sort of on the red carpet so to speak. I confronted him and he got extremely hostile.

The way I see it YOU took a **** on my lawn not your dog. Dogs are part of the family after all. I would definitely take a **** on someone's lawn if they did it to me and I knew who it was. I would also gladly pick it up and throw it on them if I catch them red handed and they refuse to pick it up.

I live in a well to do area in Encinitas and these people act like they grew up in a trailer park....which I am sure a few have going by what I see.

But what happens if it gets physical ? I see it and they refuse to pick it up then I am forced to act upon it. Who gets in trouble ?

There was an urban myth years ago that a condo association in LA required dog owners to submit DNA samples of their pets poop. If poop was found on the lawn or walkways it was tested and if linked to a condo owner that person was fined.

We live in a large condo complex and most people do pickup pet poop. But there are 10% that never pickup. In some cases they let their pets go right on the sidewalk. Some will even bag the poo but just leave on the ground. When I walk our dog at night I always bring a flashlight.

.

This is a first. If it works I would support it. Most places have a meet and greet before a pet moves in. Not a bad idea for a stool sample either.

COVID has been found in dogs. Look at the Gorillas who got sick at the SD Zoo. This is serious health hazard akin to not picking up the garbage.

What I need to know though is what happens if you see it and have to confront it ? Would any of you just allow it and say " oh well ? " What would you do if that person refused to pick it up ?

I've already threatened to beat some **** but it will go sideways every time so why bother. Just follow them and find where they live. Somehow a note on the car window and some poop under the door handle fixes the problem every time.

It’s a real thing. Poo Prints.

I haven’t seen it in California, but I have seen it at condos and apartments out of state.

Defend yourself from what? Think about that for a second; you see a person letting their dog poo, you pick it up and throw it at them, and your explanation to the jury is what? You sensed imminent harm/death from the mere act of witnessing dog poop being deposited on your lawn. Put yourself in the shoes of that jury and think how your defense would translate. Short answer is throwing dog turds at a person, no matter how much *you* think it's justified, could net you a charge of simple battery.

Again, look at your language above. You're being "forced to confront" someone? No jury would see it that way as you're the one making the choice to confront people and presumably get physical with them. That's an overt act on your part, not theirs. A self defense claim doesn't fly if you're the aggressor.

Depends on how you confront it. "Hey, could you please clean that up?" --- fine. You {picking up turds and hurling them at the owner, yelling and screaming at them} --- multiple potential misdemeanors for you. Just yelling at someone can be charged as assault.

I get that this is annoying but you need to be smarter. Your concept of self defense both legally and tactically is very skewed. First rule is always to avoid conflict. In every scenario you describe, you're walking right into it and being the aggressor. Be careful.

My front yard is xeriscaped - - dogs don't seem to like going to the bathroom there.
