Do some research on how bad texting has become. The amount of injuries and death just begged for legislation. I was following a car yesterday when he made a left going the same way as me. He swerved into the far right then corrected himself back. He then drove 10 mph below the posted speed for no apparent reason. I passed him and at the next red light I saw the reason. He was texting as he was slowing for the red. His window was down so I yelled out asking if there is some reason why texting while driving was so important. He sheepishly smiled and put his phone down.

Again. I don't disagree that texting is dangerous, but how is texting any more dangerous than any number of other things a driver could be doing that would be distracting? I go back to the example of playing a game on a phone or Nintendo DS. It's not as common, but I'd bet just as distracting. Make one law that covers it all (which you already mentioned is covered under § 46.2-852 Reckless Driving; General Rule...), then there is no need for more legislation.

HB1907
and SB1222, Allows police to stop and ticket people for texting while driving
and increasing fines for it from $20 to $125 for a first offense. It had been a
secondary offense, meaning police could ticket it only if a driver is stopped
for a superseding violation such as speeding. The law also provides for enhanced
fines for texting drivers who are convicted of reckless driving. (Chapters 790
and 752)
Fine should have been higher. Law should have been raised to level it is in NY/NJ.

According to the story linked below "$100 to $150 for a first offense and up to $400 for multiple offenses" and five points on your record.

Wisconsin just went to $800 for third strike.

What I fail to understand, with todays technology most can either communicate thru Bluetooth or use the text to voice app that comes included with the phone. Yet a day doesn't go by that I don't pass someone laying their smartphone on their steering wheel texting away.

We didn't have these problem with the CB generation or the portable Ham Radio operator generation.

Here's another take on complying with the new law here in Virginia. I have an older car so I haven't encountered this situation yet. While I was reading the editorial I couldn't help but smile....

My Samsung S3 works just fine thru my Bluetooth to play music. Takes commands w/o a hitch.

Gotta love how Virginia LEO's don't seem to give a crap about DUI. Catching someone driving in a straight line on an empty road with no other cars around at 80 mph in a sports car seems to also be part of a greater agenda than catching drunks. Seems like everyone in my area takes to the roads drunk but it's "all good".

This has to be one of the most uninformed posts I have ever seen on CD. I'm not even going to try and change your mind other than to say you are clueless. Do some research yourself and learn how many DUI arrests are made each year in Va.
