You probably don't know much about HOA's based on what you wrote. They rarely get involved in disputes between neighbors like this and have no authority to make one of them pay thier share of a fence cost between yards, nor can they lean or evict over something like this. The only time they can do any of this is if the fence is owned and maintained by the HOA. Which is rarely the case regarding fences between residences.
