Our neighbor behind us just poured a large concrete slab that is about two feet away from our property line. I called our HOA to find out about setback restrictions and they said 5 feet (but somehow it was approved by the Architectural Committee). Today, at the Austin Home Show, an architect said 10 ft. Can anyone confirm the COA setback requirement for me? What happens if someone builds something unpermitted that extends past the setback line? Thank you!

If you have a copy of your plat then setback lines are noted on there.
If you are in a subdivision then the subdivision rules apply (as noted on your plat).
You don't know if the developer got any waivers on COA regulations when they got their plat approved.

I know for sure that zoned SF1-SF3 zoned residential is a standard 5 ft from side and 10 ft rear setback across the board.

Only exception if you go BOA and prove a hardship or can prove from overhead aerials that the accessory structure sat present for over 10 years. But sounds like a code violation on neighbors part..if a ,major concern u can report to Austin 311.

Thank you zakas80. The issue we have with this slab is that it's a sport court and as of yesterday afternoon, it has other structural pieces that are 30" from the fence. We're also concerned about drainage now. I visited the planning office this morning but it's not residential Wednesday. So I'll try again tomorrow. The sport court vendor supposedly told the homeowner who supposedly told the HOA manager that a permit was not required because they used permeable concrete. Based on my experience with the city, if you build just about anything in the recharge zone, it requires a permit. We don't want to make a huge stink but would like screening of some kind with the structure so close to the property line and we'd like someone to look at the drainage.Thanks again for your help.

Is there a fence on the property line? I doubt any good can come from a sport court two feet away from a fence . Unless, of course, YOU get to enjoy the sport court!

There is a fence. Our HOA confirmed today that the plans they approved were different than what was installed in numerous ways. I never wanted to be THAT neighbor, but now I am.

Doesn't sound like they were close to meeting regs. Is this the only place they could install it? Dang!

It's the only spot where THEY can't see it from their family room. It's blocked by their two story 1000+ sq ft playscape.
