Looking at these 2 vehicles. Both have approximately 35k miles. The BMW is a couple bucks more expensive but close.

Always wanted a BMW but, the maintainence costs have me concerned. It is not CPO.

Any opinions/advice is welcomed.

Does the MDX have SH-AWD? If so, it is a no-brainer.

I'd take the MDX. The only advantage the BMW has would be performance, and that's if you're buying one with the V8. If it has the I6, then go with the Acura, hands down.

Until the 2014 model, this is true. The new "redesigned" ones, have a 2 wheel drive option.

Well, the BMW is newer and it is a bmw.

Obviously also depends on each car specifics, accidents and stuff, but assuming no bad things, 35k miles is nothing for both cars.

Also since it is 2010 check if the X5 might still have some warranty/free maintenance left.

The MDX will be better for its intended purpose as an SUV over the long-term than the X5. An out-of-warranty, non-certified X5 is going to cost significantly more than the MDX in terms of maintenance and repairs, at least for the typical owner (like me) who does not work on their own vehicles.

MDX has center-latch if you have kids or plan on having them.

I wouldn't buy a non-CPO vehicle. If you can find a CPO X5, then get it; otherwise it's the MDX.

CPO X5 and buy the extended warranty, or buy one from Carmax with the extended warranty if you want the BMW.
