Long time reader, first time poster, thank everyone in advance for your input.

We are currently about to purchase an acre lot near Captain Cook that is Zoned A-1A with a teardown situated on the property. We understand that in order to turn it into a liveable residence we will need to pull permits for demolition, convert to septic, and build new.

I have been scouring the HI zoning code, county websites, these forums, as well as trying to get in touch with people in the appropriate departments, and I can't seem to understand the requirements in regards to the following:

1. Wondering if we can tear down an existing structure and throw into a dumpster without having to worry about potential hazardous materials (lead paint)? Is there any inspection that needs to take place BEFORE demolition can start?

2. Ultimately we will want to add a second dwelling on the property (after first has been constructed and inspected), we understand the only chance of this is to apply for a farm dwelling. Does anyone know if there are restrictions on what a "farm dwelling" actually is? For example, what about a 2 bed / 2 bath home with a kitchen? Is there a minimum output of agriculture in order to be approved for farm dwelling?

Any information or direction where I could find these answers will be greatly appreciated.

In order for you to apply for a 'farm dwelling' your land has to be designated as 'Ag' (agricultural) by the county. Also, I'm not sure that construction material is allowed at the dump -- it's not in Hawi. I've seen the county sitting at the site and turning people away for that.

Have you tried to call the county office for information? They were always helpful when we had questions. Good luck!

Building and Planning departments have a staffing shortage and are way behind. Plan on things taking a while. Oh, and be super nice to anyone you deal with.

One of the best parts of a 'tear down' is that frequently they are salvagable buildings. If it is a permitted building and if it's possible to restore it to use, then you don't have to get permits, build to the current code, etc., etc.

If you get picky, there's some rules about which code you have to build it to. If it's more than a certain percentage restored, then you're supposed to bring it up to a certain code, if more than another percentage restored, then to current codes, but it's not something that is inspected prior to starting so most folks just get an old building and restore it to the way it was to avoid permitting and building to new codes.

You may have to have a certain amount of farm output in order to get the farm dwelling, but the people to ask for certain answers is the Planning Department.

Im gearing up to buy land in south capt cook as well, been doing research on random things so ill take a stab at trying to answer your questions...

1)You cannot dump wood longer than 4' and any load over 5cubic yards needs to be taken all the way to the landfill, which the closest one to you in capt cook is in north kona by Waikoloa (pretty far away). See code below.
You could rent a dumpster/ "roll off" but that can be pricey depending on how long you need it and the weight of materials/trash you put in it. you pay a base rate/delivery (approx. $600-$800) + weekly rate + final weight of the materials.


2)A farm dwelling:
"In most zoning categories, only one single family home is allowed. On Ag-zoned land additional farm dwellings may be permitted upon approval of an agreement submitted to the Planning Department with a farm plan or other evidence of the applicant’s ongoing agricultural use"

So you'll need a farm plan and pretty much farm operations to justify a farm dwelling. and whoever stays in this dwelling will need min. 8hrs/wk work on the farm...

B. PERMITTED MATERIALS:[list=1][*]Household refuse, residential do-it-yourself construction and demolition not exceeding 4 feet in length, soft compactable bulky items (mattresses, stuffed chairs, and couches) and residential self-hauled greenwaste. (County Code §20-43(b)(1))
Residential ‘Do-It-Yourself’ generators of Construction and Demolition debris (C&D) disposing of wastes at any County Transfer Station are allowed only one (1) C&D load per customer per day. C&D load shall not exceed 5 cubic yards. (e.g. 5 cubic yards is equivalent to one (1) full sized pick-up truck with 8 foot long bed filled to its entirety up to the top of the cab level)
*If during a single day period a Residential ‘Do-It-Yourself’ generator has a second load of C&D material they are allowed to take the second load (< 5 cubic yards) directly to the landfill (not the Transfer Station). Tip fees will apply.
Loads greater than 5 cubic yards will need to be accompanied by a County approved *Residential ‘Do-It-Yourself’ generators are allowed only one (1) C&D load per customer per day at the landfill. *Residential ‘Do-It-Yourself’ generators of C&D material exceeding the one load per day limits may dispose of an additional load (based on limitations above) the following day during normal operating hours.
