Hi;

Just a question about rent rules in SC. I'm renting apartment and my rent finish by end of July. However, landlord want me to decide now if I will renew the contact or not. Becouse he said there are other people want to rent the apartment.
My understanding, you should give a notice before ONE month of contract expiry.

Is the land lord right to ask me to decide now, because I'm not sure yet if I will renew or not?
How should I reply to land lord.

I'm not an attorney and I'm also not sure if the sc landlord tenant act says anything about this particular situation. So my disclaimer is everything I'm about to say could be wrong. But my understanding has always been generally speaking the sc landlord tenant act requires (I think) at least 30 days notice from the landlord in typical situations. So my guess is that, unless perhaps the lease states differently, he can for any reason with 30 days notice tell you he no longer wants to rent to you, and especially if it's more than 30 days while allowing you to rent through the lease term. So my instincts are it's irrelevant that there are other people wanting to rent your place. If he gives you notice now for the end of July that he no longer wants to rent to you, then that's all he needs to do. But again my instincts may be off here. Maybe others have better advice.

There is no specific time limits that a landlord can request a decision on renewal. Either tell him you will renew or make plans to move out once your lease is up.

My contract specifies 60 days. It's becoming the norm.

Yes, that is also my understanding, except i was thinking 30 days.

He is doing you a favor by asking you if you want to renew. Apparently he has someone who wants the property and would rather go ahead and get them under contract rather than lose them. His action leads me to believe that you are a good tenant that he would rather not lose but he is a businessman and has to protect his income stream.

If you like the property and intend to stay let him know and hope he doesn't get another tenant. You might want to go ahead and see if he will sign an early renewal. All he has to do it tell you 30 days before the lease expires that you have to move out and you're legally obligated to go.
