IDK, it says the helicopter was camouflaged, and it was on a trail that was designated for snowmobiling. How was he supposed to see it? They could have illuminated it if they knew they were parking it in the middle of an active trail used by snowmobilers. He's had multiple surgeries so far.
He did see it. He said he saw something but didn't know it was a helicopter until after the crash. It doesn't matter what it is, but if you see something blocking your path you need to take action.
He also had had a couple of beers and by many reports was speeding. Both of which would be huge contributors to the crash. Had he not been speeding, and been 100% sober his reaction time would have likely been good enough to avoid the crash or at the very least minimize it.
I suspect his "two beers" was probably a bit off. Isn't this something drunk drivers tell a cop when they get pulled over? "I only had one or two"?
I have seen a lot of cop shows. Every driver who admits to drinking says "I only had 2 beers." Some wind up three times the legal limit. Two beers. Yeah. Right. Maybe two 40-ounce beers.

I run my 4wheeler at night. It has things called 'lights'. Actually 2 sets- front pair just like a car, and center one up high. And they even have *gasp* low and high beams.
That guy was pie faced and was likely drinking all day.
He already did. He sued and already settled out of court with the land owner.
He's now going after the "Big Fish".
I have a feeling the airport owner has realized the error and will prohibit anyone from using his/her property ever again. I guess they never considered the liability exposure allowing snowmobiler's to use their property. If you own property and someone gets hurt they WILL sue you no matter what the circumstances. Some shyster lawyer will take the case and at a minimum you are going to have to defend yourself in court.
