Ok so since you all are so helpful I have yet another question :/ we have narrowed down our search to Mckinney and Frisco. We will be renting and have seen a lot of beautiful homes. What I would like to know is how hard it is to get into a rental down there? Here in Wichita they don't really look at credit...they are concerned with monthly income and job time...also references... Is this the same in these areas? Or is it a bit more complicated than that? Thanks guys

Homes are typically owned by individual landlords so each will have his/her own policy. Many people are involuntary landlords ..... they couldn't sell or decided this is a bad time to sell so they are leasing out their homes ....and hire property managers. At any rate, you will find various policies -- not a singular one. As a landlord, I use a service that checks credit, criminal background and does an eviction check.

A simple background check- credit & criminal- is most common. If there are financial "red flags" in the credit report, landlord will either pass or want a larger deposit/ more moths paid upfront.

There is another good thread on the forum asking about rental market. It should help you understand how competive listings can be these days.

They check your criminal history for a rental in Texas? How far back does that go? So if I someone has a youthful indiscretion on their record they can say yes or no to renting to you? Or do they follow FCRA rules, 7 years I believe.

If it was in your youth and you have had no issues since, you can ask the courts to seal your juvenile record and they will usually do it. I think you need to be 21 to ask and have had no problems for 4 years but I didn't google it to check.

They can if the want to. Youthful indiscretions (under 18) are sealed. If someone snatched a dirty magazine from a quickie mart in college and they're now a 50-year-old middle manager it's probably not an issue. If the same guy assaulted a woman in college or has 5 DUI's, then hell no I wouldn't rent to him.

It's no different than a job application. Larger landlords or management companies will run your SSN or name/DOB for a quick credit/criminal scan.

Employers have to follow EEOC guidelines. However, to my knowledge if its on public records it will be reported to LL's and employers by the background companies. BTW, juvenile records are restricted but they are NOT sealed unless directly requested by the individual. Also certain crimes can't be sealed (like murder). Unfortunately I know this firsthand as a parent of a kid who had some criminal trespassing charges from breaking into a rec center when he was 12 with friends.......

You can find a reputable BK check company online and pay a relatively small fee to find out what is in your BK check. I don't know what length of time they span, but my guess is that there is some standard national time, either past 5/7/10 years?

It really depends on the situation. There is no set rule that makes Texas background checks any different than any other state. A background check could potentially include anything on your record since the beginning of time.

But if it was more than ten years ago and not a serious offense, I wouldn't worry about it. Most of the time, employers and landlords don't want convicted felons or sex offenders. But some landlords and employers don't care. It depends on so many factors.

I don't think the Texas rules would be any different than Taxachusetts.
