They are ants- termites do NOT have a pinched thorax- the ants in your picture do- as well as an illustration posted by another member.
my wife seemed pretty confident that they arent termites. i figured i would buy a spray that kills ants and termites just to be sure. i checked the area outside of the house and didnt see anything. i blew out the leaves and sprayed the perimeter with the insecticide.

Buy a bag of this and sprinkle it liberally. It won't hurt you, the kids, or pets. You can even eat the stuff. But it will kill insects 15 minutes after they walk through it.
