And that is full true. It is not problem that they get instate tuition price (as wrote in another tread) then after they get in state tuition price they get federal pell grant and help from social service. Why I have to pay for some Indian or Chinese to study? How if my money would go to wounded veterans or theirs children? Past year Romney said at Fox news:” as is right now any one from any where in world can come here at tourist visa and study at expenses of US citizens. For me it is criminal.”. If someone would do such tricks in Germany they would take him to jail. What is wrong with this country as illegal can study for free and US citizens do not have money for college?
International Students cannot join any University on Tourist Visa. There is F-1 visa for international students. In university, international students are charged higher tuition/fees then American students. and they are not eligible to even work off-campus.

To teach you something none of that Indian and Chinese students do not pay a dime for theirs education. They study at expenses of US citizens. Only a few middle east and western Europeans pay for it.

But apparently there is preferential treatment for some foreign students. They not only aren't required to have student visas but get in on instate lower tuition rates and are even given tax dollars that citizens don't get and other foreign students don't get.
However, this apparently is not illegal as far as these particular students. They aren't breaking the law, the law simply gives them preferential treatment.
Unless it's like taking jobs after coming here with tourist visas or border crossing cards which is definitely illegal but extremely common. If they pay their own way it would be one thing but the law should be impartial, if some foreign students pay the foreign student rate, all should pay that rate.

Legally, they cannot study on tourist visa unless it is a non-credit course they take. If it is a degree then they are required to obtain a student visa. It is relatively very simple to obtain.
I guess you are talking about illegal students. They come here, reside one year and after that qualify for in-tuition state and grants under DREAM act. However, in California they would have to prove residency of at least 1 year to qualify for in-state tuition. If they have relatives and US address they could easily forge it though because state ID or driver's license are not only the factors that determine state residency.
