I don't live in one, but my two rentals are in them. I had trouble with the Summerlin Association North a few years ago with my rental located there, weeds on the side of the house, near the a/c unit...nothing horrendous, but I was amazed the "inspector" even spotted it, it wasn't a big, tall weed or anything and I suppose the landscaper was missing it when he came to cut the lawn...

Yeah, I don't know about that. My HOA has elections every year or two years. Each unit gets two votes, and votes by secret ballot. Prior to this a notice goes out with the names of candidates and a brief bio/intro of each person. I think maybe the president is a two year term, and the other officers are one year. There is no clause, however, to how many terms a president of the HOA can be elected for. Usually they don't last more than one or two terms.
I'm not sure about the legal aspect, as NV laws are much different than those of my home state (NY).

You are talking nonsense. This is the ultimate in a capitalistic arrangement. Actually limited in its depth somewhat by the government. But for an unrestrained libertarian this is the ultimate.
It is called a contract...freely entered by an initial purchaser and running with the land. What could possibly be more old english capitalist than that.
If you don't like it don't buy the place. Note however that such a decision bars you from virtually all current tract housing and most custom stuff. The only way around it is to buy an old place or raw undeveloped land.

The HOAs hold more power and clout then any country president or any law enforcement agency.

Kind of a burn by olecapt. Totally true that he entered into a contract free and of his own accord. The HOA didn't confiscate the land and collectivize it.
However, if an HOA becomes truly corrupt it can be like a Nazi state. Never actually heard of it, but if the board voted and got approval for un-limited terms from the homeowners, serious abuses of that power could easily occur.
Maybe the guy just got blown off by the board when he showed up to a meeting and is venting? Would like to know more details.

Oh puh-leaze. HOAs are limited in authority by the state and federal statues. For example, HOA rules against satellite dishes and antennas on rooftops were overruled by FCC regulations.
Further, you are the HOA. You have a percentage of a vote in the HOA decision based on your percentage of ownership into the HOA. There isn't a dictator running unchecked like Chavez.
What struck me as a possible problem was when you said that there was a "good ol boys" club that voted themselves unlimited terms on the board. That is a serious problem and may potentially violate state law, if it is truly what happened in your HOA.

Olecapt you went over my head with that one. What the hell are you doing selling Real Estate with an exceptionally intelligent head on your shoulders like that?
Ok so I was exaggerating just a little about the HOA closed boards. But you know there are quite a few HOAs as I described that are closed to new members. Mostly the older neighborhoods.
You are right about to avoid HOAs one has to build and/or buy way outside city limits. Or buy something old. Which I did. So we all here have quarter acre lots and it is nice to not open my side door and hit the house next to me with it. It is nice to have a more closely knit community where we watch out for eachother rather then spying and peeking over walls to see who is breaking rules, then to rat on eachother.
My biggest problem is swimming naked at night in my private back yard. The air cops are quite fond of just flying around all night shining their beams into peoples yards who choose to swim with no clothes. I know I am not alone because this subject of the air cop perverts have come up before.
You should stop short of telling me if I dont like it then dont buy it. It was you who sold it to me without explaining what an HOA was. I had no idea at all as I explained in an earlier post. Thats ok. Im not complaining. Your an ok guy in my book.

I know what you mean about HOA. In ours 2 of the boardmembers are breaking two of the covenants, plus charging the home owners for water from the wells. Which is illegal, the state water guy is coming to pay him a visit. Oh revenge is sweet.
