I have a mother daughter home and I am no longer using it as a mother daughter since the passing of my mother. I called the building department who told me that in order to not renew the Mother Daughter permit I have to rip out my second, right now legal, kitchen. It is only 10 years old and of very good quality. My plan is to sell in a few years, and I'd like to keep that kitchen so I can sell it Mother/Daughter ready. I find I am dealing with a very nasty inspector. Does anyone know if it's legal to have a second kitchen without a mother daughter permit?

Is the Town forcing you to remove the kitchen, or are they giving you the option to keep your M/D permit but just pay the extra taxes? If the latter, just go with that option.

This is one of these building code paradoxes; a Mother-Daughter is only legal when it is actually occupied by a family member; once it is not occupied by that family member, it is considered an illegal apartment (even though it was perfectly legal before).

Renew the permit, a lot less hassle than ripping out a kitchen that isn't that old.

How much to renew the permit? If you sell it in 5 years e.g., and the permit is $500, it's only $2500. And you sell it high at the end.

Yes it is legal to have two kitchens without a mother/daughter permit.
1) Demonstrate how the 2nd. kitchen is inseparable from the rest of the house (ie. doesn't have its own outside entrance)
2) Explain you don't have the desired room in the primary kitchen to follow Kashrut (Kosher) rules.
3) Reduce the size of the sink to a prep/bar size (ie. 13"x13")
4) Remove all heated appliances (those that cook with heat...plug-in microwaves are okay)
