"helping one, hurting thousands"???? What a communistic and brainwashed view!!!! Turn your neighbor in, God forbid he pays his mortgage on time because of that income!… In socialism they had people spying and turning everyone in as well…Yeah, yeah, I know “they shouldn’t have the house in the first place”….Well let me tell you something… 1. Most people are underpaid for their work despite their qualification, experience and hard work (maybe you disagree on this one too????). LI employers take advantage of their workers and with more and more companies moving out, they will continue to do so. So I guess these people should never have a home, they should keep renting, but then they are going to get old in their rental apts and they will go into medicare/ medicaid facility and since they have no assets, the government will pay it all, YOU $$$ will pay for their entire long term care….It will cost much more than $500- $700/yr that you are crying about (average property tax increase for a legal apt in Suffolk). Then you will start a thread complaining about that, then someone will quote you “ law is a law”….2. the town, government, or even cablevision keep increasing the charges b/c of rats like you… Do you honestly think that your town will voluntarily lower your taxes if all illegal apts get legalized? Did they lower the taxes when the house values went down? Not unless you grieved them!3. another comment said “law is the law”… Again, you are brainwashed! Just cause there is a law about something it does not mean that it’s correct! Not so long ago we had laws prohibiting “color” people from living in certain places, or hiring Irish or some other nonsense! That was the law! Was it right? Was it immoral to not obey it? Think about it, Why should you pay more property tax if you have that apartment? Is your property getting any bigger? Do you live in more luxury if you share your house with others? Many countries base their taxes on zip code (location) and property size…. Why should it matter what kind of house you have on your property, or how much repairs or improvements you’ve done? Didn’t you pay for those with money that was taxed already? If I convert my f garage into a living space and I spend my own taxed money to do it, why should I pay more taxes?! I can go on and on, but what’s the point…..the problem with American’s is in thinking “I” instead of “we” and seeing everything in black and white, forgetting that there is a ton of grey in the middle! No common sense. P.S. I do follow the rules, but they have to make sense to me otherwise you must question and dispute them! Hey the world is not FLAT…. It took a rebel to fight that!

i am living in a one family house.But the landlord rented it with people allready living in it. he also knows that they are illegal imigrants.I do not have a lease just a written consent from him.He told me these people that rent a room from him were to leave in a month.But they never did.The landlord later told me that these tenants had a lease and that they were staying because the utilities were under their names.I also have three children and he had to sign an affidavit in order for them to be in school, it took him three weeks to give it back to me.And everytime i went to pay his rent he claimed that he did not have any rental receipts that he would give them to me when he got them.Stupid me never even gave that a second thought he was very nice.Then problems started with the other tenants, they started stealing my things and shutting off the hot water and heat.This was the coldest winter ever I told my landlord over and over but he just ignored everything I told him about the poor insulation in the house, he ignores me so I witheld rent from him and he shut of all the utilities in the middle of winter.The other tenants were conspiring with him and ""moved out".You see they were plotting on having me arrested. The tenants moved at the end of the month,they removed their things from their bedroom then they told me that they would be back the next day to get the rest of their things.Three days passed and they did not come back so I went into the room and found bottles full of pee and garbage all over gum stuck on the walls it was nasty, it took me two hours to clean.the next day i get a knock on my door from the landlord who has bought the previous tenant who claims that i went into his room and took out his ""personal belongings"" and that he was going to call the police which he did.when they told their side of the story the officer came into my house and told me that they said that i removed him from the house by throwing all his stuff outside.I could not believe it and neither did the police when i told him my situation and took him to the basement and showed him all the violations that the house had.He told me the house was unsafe and that i needed to call the fire marshall.But it doesnt end there the landlord demanded that i give this previous tenant a key to the house and that he be allowed to get back in his previous room and i refused but the police said i could not because he had a lease and i did not and the land lord wanted him in the house.I told the officer that the utillities were under my name and that there was going to be a conflict because he has been harrasing me and turning off my hot water in the basementand that I had to pay some over due utillity bills from before i moved in here in order for them to turn them back on without me having a lease.T he police said that the law says that the landlord can choose to do what he wants so the next day i called code enforcement and the fire marshall to come and inspect the house.I got an even bigger surprise when he told me that this land lord not only does not have a permit to rent but is not the actual owner of the house.Im packing my stuff and kids but i dont know where to go or what to do.

If a building has an illegal apartment in it, the homeowners insurance on the building is invalid. Should anything happen to the building, the owner will have no insurance and will be 100% personally liable; in all likelihood bankrupt. But wait it gets better....just the lack of valid home insurance is a breach of the mortgage contract, so the lender can foreclose on the building! If you really want to hurt an illegal apartment landlord, call their mortgage lender. The city/town may be own thing in regards to fines and punishment for illegal apartments, but the insurance company and the bank are a totally different and much more aggressive group for the landlord to deal with. While it may take the city a while to do the inspection, the insurance company will be there same day as the complaint! There is nothing an insurance company wants more than a reason to invalidate an insurance contract. Give them that reason! Do you like living next to or in a building with no insurance? Do you like uninsured drivers on the roads? No, then do something about it. The name of the mortgage lender is available with the city clerk's office.

I found this thread and am very interested. I am currently living in an illegal apartment in the same area and am looking to move out at the end of the month. Here is a little background.
We moved in on May 1, 2009 and soon discovered that the homeowners were awful landlords. They told us we could write them checks for monthly rent but that the checks had to be written out to cash. They accepted our first and last month's rent (that is what they asked for- no security deposit) in check form but when we went to bring them our rent for June, they demanded cash. There is no written lease and they refused to write us receipts. We had no choice but to accept it or look for housing elsewhere- which would have been a pain since we had just settled in. They have been extremely inconsiderate over the past year- letting their children run up and down the stairs that lead to our apartment, not giving us our mail for days (sometimes weeks) at a time, constantly disconnecting our cable which was supposed to be included in the rent and blaming it on their children, etc. In November, they entered our apartment without our permission while we were out of town (we know because they placed our mail on our kitchen counter instead of it being slipped under the door) and when we tried to have our own cable installed in our name after we discovered it was disconnected for the 5th time in 11 months, our landlord stopped the technician from entering the house and never said a word to us about it.
On April 1st, we wrote them a very professional letter (with no personal notes about or dissatisfaction) stating that we would be vacating on May 1st, 2010 and please use our "last month's rent" for the month of April. This past Saturday, I came home from running errands and the door to our aparment was wide open. When I confronted her about it she said "oh, well I was in the kitchen, we have company- the kids must have done it" then she advised that she received our letter stating that we are leaving and we have to be out on April 30th as that is the last day of the month.
I realize that this is true but my boyfriend, myself and our friends and family that will be helping us move all work full time and we really need a couple hours on Saturday morning, May 1st to get the larger stuff out of our apartment. I didn't think that was too much to ask.
I basically have two options- 1-ignore her request to have everything out by the 30th and take the few hours on the morning of May 1st to get our stuff out (what can she really do? call the cops? We're already leaving) or 2-we can move all our stuff on the weekend of the 24th and 25th into our new apartment and demand that she pay us back for the last 5 days of the month that we will not be in the apartment that we have already paid for.
What are everyone's thoughts on this? Anyone with actual, legal input would be greatly appreciated.

Actually, neither of your ideas is very good. Why not simply ask if it would be alright to move out the morning of the first? You might offer her a few dollars for the one day hold over.

Man up & pay her for Gods sake! She may lose her house because of you. You had an agreement with her to pay rent & she provided you with a roof over your head. I would start looking for a new place to live. Oh your out of a job! than good luck on finding a legal apt to live in as you will most likley be rejected on a credit application . Your only resource will be finding another illegal apt to live in & someone desperate to make ends meet to keep a roof over thier heads. So if you want to throw her under the bus for an illegal apt? Think about it .

What school district are you in? The smart ones have hotlines for people to report illegal enrollments to. Also what municipality are you in? They all have hotlines for illegal rentals.

TomMoser- That would be great if this woman were reasonable, but she is not. We already requested a few hours on the 1st but she said she wants us out on the 30th, which is not possible without leaving an entire week early. Since the extra 5 days we will be in our new place will most likely be prorated into our rent, I feel like something needs to be done.
This woman has made my life a living hell for almost 12 months now, I have no desire to throw her any more money for the few hours of extra time I will need to get out of our apartment.

If you stay until the 1st all that she can do is call the cops, and without a legal eviction notice, there is nothing they can do. If she does call the cops, you will show them that you are moving out and they will probably just tell your LL to calm down and let you move.

If she does anything on the 30th (turn off utilities, harrass you)...you should call the cops immediately
