The bottom line is that I hate when people label it as a "loophole" - it's a federal law. Don't like it, change it through legislation - SCOTUS should not be involved in it.

Congress may not, but SCOUTS, if it's fortified by Clinton appointees, will most certainly "interpret" the Constitution to support any manner of Democratic nonsense.
