Foreclosure was last fall, I just discovered.

How does this work? Is he going to be kicked out at some point? (This would make me happy as the property has become extremely run-down and littered with trash and broken down equipment and toys).

He'll have to leave eventually, someone told me a while ago, it could take 8 months to get someone out whose home has been foreclosed on.

I don't know if it has anything to do with the time of the year for the foreclosure? With PA tenets it is harder to evict them during the cold months: Guidelines for Pennsylvania Residential Eviction

The problem with any slow moving eviction process is the amount of damage to the house (especially when the weather is cold). That delay can cost the owner or the bank thousands.

Be glad he is still there, once the house is empty it will be a beacon to vandals, thief's, teenage parties and such. Your problems will be far worse with that rather then a mess.

If the yard is a mess then say something to the city, township etc....

Thanks. I actually read too quickly. Went back today. The foreclosure was in JUNE last year.

As far as being glad he's still there, nope. We live in a community with lots of empty homes - second-home places. On our street there are only three or four full-timers out of 12-15 houses. Never had a single problem with vandals/parties/thieves in the empty houses. Not one. We've been here since '99. The problems have only ever been with the people who actually live here. How screwed up is that....

I don't want to say anything to the HOA. Because of the remoteness of our road, and the fact that there are no other full-timers nearby (the other full-timers on the road are at opposite ends; not near us) it would be totally obvious who had complained. And I do NOT want to antagonize this guy. His wife & kids moved out last year and he's not what I would call a pillar of the community to begin with.

It really takes a bit to get rid of someone that's been foreclosed on. I know one house in my community that finally showed up for sale on a website. This house was foreclosed on for over a year and I know the owners(former I should say) were living there for over a year. More close to 2. I don't understand how it works to get rid of a person in default.

The best one I heard was a house that was in foreclosure and had a for sale sign on it with the banks information. Along come a couple of " entrepreneurs" that took the sign down, mowed the lawn, changed the locks and did a once over on the inside of the house. Next they ran an ad in the paper for a house for rent. Along came a potential renter and was shown the house. The rent was $1100.00 per month. So, first months rent, last and one month security later.....I think you know where this is gonna end up. LOL.

There is the actual foreclosure where the property is sold at Sheriff's sale most likely back to the bank that was the mortgagee or the process of foreclosure that can take up to 1 year or more during which time the occupant of the house gets to live there free of charge.

The new owner can evict anyone living in the house on short notice. The person occupying the foreclosed house may be paying rent to the new owner or the bank is so bogged down with foreclosures that it just can't deal with many of the worst properties. This is the case with government mortgage companies like "Freddie Mac."

According to Zillow, the notice of foreclosure happened at the beginning of last year and the bank bought the house at a foreclosure sale in June. It's not up for sale right now.

(Of course the information could be wrong, but the way things have gone downhill next door, it seems to indicate Zillow is right.)
