The DUI laws in VA are tough but I don't think people generally get jail time for a first offense especially if there was no accident or injuries, which i presume there wasn't since you didn't mention it. Just get a lawyer and deal with it and learn from the mistake and never let it happen again. I also find the self righteous people annoying, especially since most of them have probably at some point in their life driven after drinking a few, but were just lucky enough not to get pulled over.

The charge had to have been dismissed for another reason. The suspension at the time of arrest is for 7 days and it's automatic. It's an administrative suspension and the courts have upheld the legality of this.

Quick question - after the 7 day mandatory license suspension, do they mail you back your license? How do you drive without one after the 7 days?

That would be true except she falls into the ''super drunk'' category which has mandatory jail time. Virginia DUI Laws |Drunk Driving Fines, Penalties| SR22 Insurance | drivinglaws.org I know a girl at UVA who blew a .22, and she never left a private parking lot. She started her car, moved a few feet forward into the car parked in front of her. She spent two nights in jail initially. After the trial, she spent another 12 days in jail, lost her license for a year, had to pay big fines and big lawyer fees. She also had to attend AA meetings and driving classes. A .15 is 'only' 5 days in jail, plus all that other stuff.

I agree with you, the self righteous folks are annoying. Who among us hasn't done something that we regret? Drunk people don't make good decisions. duh. They're thinking is so impaired they think they sometimes think they are ok to drive when they aren't.

Went to jail for 3 days. I did see other cases since where people who blew very high were able to avoid jail time, but I guess it's just the luck of the draw.

Also, from my experience, it seems there's little difference in paying top dollar for a lawyer or only a little bit, as the DUI process has become so routine in Fairfax County.

Don't drink and drive... It's very very stupid.
