The US Supreme Court has issued a temporay stay to the execution of Texas death row inmate Duane Buck.

Buck was convicted of a double-homicide in 1995. Buck's lawyers claim improper testimony by the court-appointed psychologist may have been a factor in the jury deciding on the death penalty (rather than life in prison). The psychologist told the jury that, as a black man, Buck was likely to be a repeat offender. Buck's lawyers are asking for a new sentencing hearing.

Buck's case was flagged for review as early as 2000, by Sen Jon Cornyn, who was then Texas' AG. A member of the prosecutorial team has also asked for a new hearing.

Appeals to Gov Perry went unheeded. Perry signed off on the execution. At the time SCOTUS intervened, Buck had had his last meal, and was two hours into a six hour window in which his execution was to take place.

Hopefully, Buck will get a new, non-biased sentencing hearing. A jury still could very well send him back to death row, since his guilt in the slayings is not in doubt. But, this time, it will be without the stigma of a racially tainted trial.

It's hard to imagine Perry signed Buck's warrant under these circumstances. He must have known about the facts of this case. If not, shouldn't he have?

Did Perry know and not care? Or did he send a man to death row without bothering to find out why the case had been flagged by Texas' own AG?

Did he give similar care and attention to the OTHER 234 death warrants he's issued so far?

And, is THIS the kind of rationality, judgment, and moral sense we want in a president?

There is a judge in Texas who a few years ago knew a very credible appeal for man who was scheduled to die within a few hours was on it's way to her. She closed her office and went home. Her father worked on the case for the DA's office.
There is not much mercy in Texas.

The OP should learn more about Texas Laws. you really come across as ignorant about our judicial process..

Perry's name shouldnt even be mentioned in your post.

If you want to say that Perry is a 'jackazz' for not ordering a new sentencing then SAY IT. Don't use words like "Perry sent this guy to death row".. that just makes you exceptionally niave at best and STUPID at worse.

While what they psych said may have been improper this guy is guilty as sin.

He should have been executed years ago.
