No. "Hate" defines the purpose/intent, not the crime itself. For example, a mugger doesn't hate you, but loves your Rolex.

This woman needs to obey the law just like everyone else. If she can prove that her assault was not based on his sexual orientation, the hate crime charges should be dropped. I do agree that every time someone uses a word like f****** they are not committing a hate crime. If someone calls a woman a ***** then hits her, it isn't a hate crime, but if someone goes out looking for a woman and hurts one simply because they hate women, it is. On the other hand, if the woman had kept her hands to herself, none of this would be happening. She does have some issues she needs help with.
This is not a hate crime, nor should it be treated as one. It's assault, nothing more.

Change it into races instead of sexual orientation and it would also be a hate crime. If you don't like this then take it up with the LEOs but at some point you have to recognize your own biases.
No. To be a so-called "hate crime," the crimes must be motivated, in part, because of the person's race, gender, religion, sexual orientation, etc. That's why they're called "bias motivated" sentence enhancement laws.
Isn't it interesting that the same people blame the victim, in this case and in the Martin case.
I suppose all that matters is the race and/or sexual persuasion of the victim.
If they are black, blame the victim.
If they are gay, blame the victim.
Simple as that...
And, if the guy 'stood his ground' and shot this woman, well, none of these people would be on his side...guaranteed.
