I don't know what is the basis for any argument on this issue. There isn't a jurisdiction in the country where you can walk up to a wounded suspect and shoot them at close range for the sole purpose of ending their life. It really doesn't get any simpler.

and you know that happened for a fact because you read it? some of that story didn't even make sense, with the "girl laughing" after her friend had been "executed" and laughing as she was about to be.

i think in america we still have trials to determine what happened, unless that day is ending too.
The ambush... the girl coming down the stairs after the first round of gunshots.. not calling police until the next day... the chilling description of the act. I just think there is more to this than a simple B&E. The girl apparently had stolen prescription meds from a relative... maybe this old guy was dealing prescription meds and this was a deal gone bad?

If you want to argue whether or not Morrison County Sheriff Michel Wetzel's representation of Mr. Smith's statements to his officers are factual or not... be my guess.
But until they are repudiated I see nothing that would mitigate the fact that this was a clear cut case of murder by the laws that govern all 50 states of this country. But to make arguments about his history of victimization, the location of his home, the right to protect property, the criminal history of the victims, as justification for this crime is simply beyond the pale of a civilized society.
As for your comment regarding a fair trial. The only thing the Constitution provides to the accused is the limit upon those with the power to deprive a person of life or liberty without due process of law. There are no limits or prohibitions against me from deriving a private opinion about a persons guilt or innocence, and I have a 1st Amendment right to express that opinion.
