Another step in the right direction! Many states have zero tolerance laws which are archaic. There is a difference between active THC and non active THC metabolites. The AZ Supreme Court stated that the presence of non-psychoactive compound does NOT constitute impairment. This decision overturned the state court of appeals decision from last year.
This has been one of my major concerns with legalizing pot. It seems you can determine when one is under the influence and when one isn't.
I agree with the court here. You shouldn't be able to be charged because you smoked last week. Make no mistake though, if they can prove you smoked a half hour ago you should get charged with a DUI.

I could not agree more, from a peace officer's view. I have a problem with someone getting convicted of DUI when they were not impaired. Illinois has zero tolerance now....not for long I'm assuming.
