The law is appropriate and understandable. The way in which it was enforced was ridiculous -- this has nothing to do with the propriety of the law itself. Law enforcement officers are expected to exercise some intelligent discretion in carrying out their duties.

"Strict enforcement" of a law makes about as much sense as those "zero tolerance" rules, in which kids are suspended if they bring an aspirin to school or point a finger at someone and say "bang, bang."

Anyone else remember this?

Judge Roberts expressed his opposition to the French Fry arrest of a 12-year-old girl, but nonetheless upheld it.

Good for Roberts for opposing something personally yet upholding it legally.

I know we're all about feeelings and emotional thread titles, but it's refreshing to see a thinker think.

Indeed. I know someone involved in that case on the child's side that had a similar observation and remarked that Justice Roberts handled it professionally and with fairness.

I agree it shouldn't have happened and showed a lack of discretion. The reason it was decided the way it was is because of the law as written by the local government.

We need more State-anti-child-abuse laws!

This is a good example of where government laws can be fallible.
