The law, passed by DC, banning eating on the subway, is stupid. As was the decision of the individual cop to enforce it by arresting a 12 year old over a flippin' french fry. The foolishness of laws, especially in liberal cities, knows no bounds.
But I agree with Roberts-their city, their choice, foolish as it is. Not the place for the SC to get involved. Should the SC overrule the NYC "big gulp" law?

Metro does this and then gets the Post to feature the story about the poor little munchkin that gets abused by the system. It's to create an environment where kids are fearful of eating on the Metro.

If states wants stupid laws like that one, then they can have them, and the people in those states will start watching people leave. How does the SCOTUS have jurisdiction here?

no she wont. she is twelve, and when she turns 18 this incident will be expunged from her record, and she will have a clean slate upon entering adulthood.
in the end the law was the law, but it was a stupid law, and it was the publicity of such a young child being arrested that got the law changed. perhaps one day the people of this country will wake up and demand that such laws be stricken from the books, unfortunately chances are it will take incidents like this to repeal these types of laws, and it will happen one law at a time.
