Let's say a you have a headache and someone gives you an aspirin, but in reality they gave you ecstasy. Should you be charged with a drug crime?
If she legitimately looked like she was 17 and she lied, he shouldn't be charged with anything. If anyone should be charged, which nobody should, it should be her for fraud and promoting sex with an underage person, herself.
I hate it when common sense is overlooked in our judicial system.
It's absolutely unjust. Hopefully it will be turned over in appeals or something. That whole country sounds a bit draconian though--later in the story it talks about a woman who got jail time for saying a "bad word" while paying a traffic ticket.
In the meantime, the best way to protect yourself from this kind of situation I suppose is to make sure you really know a person before having sex (especially if the person is younger and could be lying).
I actually carded my first wife when she first hit on me just to make sure she was not underage. The girlfriend I had before her led me to believe she was 18...I only found out otherwise when her friends approached me to see if I was going to help plan her big 18th birthday party. lol Always verify.

Millions of under age teens have sex daily, lets lock them all up.
Our Prison Industrial Complex in this country is always looking for new people to lock up!

Yeah... you can't trust strangers. They can be lying about age, diseases, an angry lover ready to kill you when he finds out, just about anything. It's a free country of course, but it's why I am not into random hookups and think it's better to get to know a person before sex (not so much the age thing... I am older and date people around my own age. But there are other factors too).
I like Uncle Bully's advice on carding-- although someone could still have a fake id (but it's doubtful anyone would have a fake ID saying they were 17).
Did you read the whole thing? The judge was a egotistical jerk to both men and women. The females in this case fought for him, even the "victim" and her mom.
Its time to kill all crimes that are victimless. These two teens screwed around. Big f'in deal. Thats what teens do.
