I'm not sure if the friend is suing for monetary damages, this appears to be related to re-opening the case against Wilson. The parents have filed a suit for wrongful death and they will likely receive a large settlement.
I personally believe the grand jury did not indict because the prosecutor intentionally tanked the case and presented non-credible witnesses, including a white woman who suffered from mental illness and later admitted to fabricating her testimony.

They are of course within their rights to sue, I'm surprised it took this long.
The two things that clinched his not even being charged were the forensic evidence that showed his friend lied about several things and probably more importantly several other (black) witnesses that didn't run in front of cameras because their version of events ran along the lines of supporting the officers version of events. They were afraid to be seen helping the officers case, so much so that the NAACP provided protection for them....from BLM.
Basically, in the first 24 hours of the shooting his buddy and some relatives (who weren't even there) went in front of news cameras and lied about what happened. Months later the other witnesses got to put in their 2 cents but by then people had made up their minds.

Brown committed a strong armed robbery prior to his confrontation with Wilson.
There is no physical evidence that impeaches Wilson's story.
The bulk of the physical evidence corroborates Wilson's story including a bullet hole found inside the vehicle. Any lawyer or prosecutor is going to tell you this above all this the one thing that usually catches people if they are lying.
That bullet hole was created when Wilson was punched in face when Brown tried to take his gun.
Unlike the parade of idiots on TV that have been shown to be liars there is other witnesses to this event. I forget the exact number but there is about 4 or 5 of them that have given independent testimony to investigators and the Grand Jury that has corroborated all or some of Wilson's story, corroborates all or some of the physical evidence and just as important corroborates the testimony of these other witnesses.
Other than these idiots like Michael Brown's friend that have all given different versions of events that do not match the physical evidence what else is there to suggest Wilson is guilty? You literally have to stick your head in the sand to suggest Wilson is guilty.
I know there were tons of witnesses. It is the prosecutors job to screen out individuals that they determine are not credible and to present a cohesive story to the grand jury. The prosecutor in the Michael Brown case did not do that and as a result, no charges were filed.
As for the DOJ, they determined they could not charge Wilson with violating Brown's civil rights. This was not a surprise as there are very narrow parameters associated with this charge.
Don't care who wins or lose but whoever lose should have to pay all lawyers and court cost
