What is to say that the government will keep the criteria the same or "fair"?
For example, in the last administration, it was okay to be gay, bi, lesbian, and trans. In this administration, that is not necessarily true. On a mental evaluation basis, that could be used to deny people the license.
Opinions of what is right in the mind vary vastly. As a woman who has never married, I am sure there are those who might question my sanity. In centuries passed, I would be burned at the stake.
The government is not logical or consistent but rather, made up of people who can vary on how they see things.
Essentially, especially with history, it is quite stupid to expect them to be consistent in the protection of a right. It is more reasonable to expect them that if they have the means to decide to who gets a certain right and who does not, then they will find a way to remove the rights of those they want, especially if those means are easy.
